Restrictions Placed on Ice Cream Truck Drivers
County Adopts Ordinance Effective July 3
By Michael P. Neufeld
Wednesday, May 14, 2008
San Bernardino, CA – After a bill banning registered sex offenders from driving ice cream trucks stalled in committee in Sacramento, San Bernardino County Supervisors decided they needed their own ordinance to place restrictions on drivers of the roaming vendors.
Yesterday, supervisors approved an ordinance prohibiting registered sex offenders from driving ice cream trucks in unincorporated areas of the county effective July 3.
Previously, the ordinance addressing roaming vendors required a background check on applicants requesting a business license but did not prohibit registered sex offenders from obtaining the solicitor license.
Supervisors had hoped the loophole would be closed by legislation introduced by Assemblyman Paul Cook as Assembly Bill 2169. But that legislation stalled in committee and local officials decided to move forward by revising the existing ordinance.
The new wording provides for the denial or revocation of a solicitor license if the applicant or an employee of the applicant is required to register as a sex offender under California's Megan's Law.
Supervisors, who unanimously approved the change in the ordinance, had gone on record March 25 supporting AB 2169.
